Payment by credit card is provided by Barion. Online card and other payment methods are
handled through the Barion system. Credit card or other payment data do not reach the merchant.
Barion Payment Zrt., which provides the service, is under the supervision of the Hungarian
National Bank, license number H-EN-I-1064/2013. The terms comply with legal regulations.
- Services and Products
Bright Mind Media sells books, workshop tickets, and e-books. By purchasing products listed on
the website, you accept these terms of use. - Delivery Time
- E-book: Available immediately after purchase.
- Workshop ticket: Available immediately after purchase.
- Printed book: Delivery time 2-4 days.
- Payment, Cancellation, and Refunds
4.1. Refund Eligibility
Refunds are provided only in the form of a voucher equivalent to the purchase value. Refund
eligibility is limited to 7 days from the date of the original purchase. The voucher is non-
transferable and can only be used by the original purchaser.
4.2. Voucher Details
The voucher is valid for 1 year from issuance. It can be redeemed for any product or service
available on our website and must be used in a single transaction; remaining balances will not be
reissued or credited.
4.3. Requesting a Refund
To request a refund, please contact us at publisher@brightmindmedia.net, providing your order
details. Refund requests are processed within 5-10 business days from the date of receipt.
- User Accounts and Data Protection
Users must ensure the security of their accounts and cannot share them with third parties. User
data is handled confidentially per our Privacy Policy. - Intellectual Property
All content on the Bright Mind Media website, including books and workshop materials, is the
intellectual property of Bright Mind. Copying, resale, or any other use of the content requires
prior written permission from Bright Mind Media. - Dispute Resolution
Hungarian law applies to these Terms of Use and the relationship between Bright Mind and its
users. We will try to resolve disputes amicably. If unsuccessful, the competent court has
jurisdiction. - Other Terms
Bright Mind Media Ltd. reserves the right to amend these Terms of Use at any time. Users will
be notified of such changes via the website.
International Sales: Our General Terms and Conditions also apply to purchases outside
Hungary.
Consumers in this case are defined as individuals who are citizens of or have a residence in an
EU member state, acting outside their economic or professional activities. Businesses are defined
as entities established within a member state, purchasing products or using services within the
EU as part of their economic or professional activities. The primary language for communication
and transactions is Hungarian and English. We are not obligated to communicate in the specific
language of a consumer’s country. Furthermore, we are not required to comply with non-
contractual national legal requirements related to the product for foreign consumers/businesses.
Foreign consumers/businesses may exercise their rights based on our General Terms and
Conditions.
For online payments, transactions will be made in the currency set by our company. We may
withhold delivery until payment for the product and shipping has been verified. If payment is
incomplete, we will notify the consumer/business to settle the outstanding amount.
Consumer Information under Government Decree 45/2014 (II. 26): Information on the
Consumer’s Right to Withdraw: According to Civil Code Section 8:1 (1) paragraph 3, only
individuals acting outside of their profession, trade, or business activities qualify as consumers;
thus, legal entities cannot exercise the right to withdraw without justification.
Consumers have the right to withdraw without justification within 14 days based on Government
Decree 45/2014 (II. 26) Section 20. However, the right to withdraw does not apply to virtual
products subscribed to on our website.
The right of withdrawal is not exercisable in the following cases:
- Newspapers, journals, or periodicals, except for subscription contracts.
- Products inseparably mixed with other items after delivery due to their nature.
- Contracts for leisure services where a specific date or deadline is agreed upon.
- Sales of sealed audio, video, or computer software if unsealed after delivery.
- Custom-made products, items tailored to the consumer’s request.
- Digital content not delivered on a tangible medium if fulfillment has started with the
consumer’s prior explicit consent, with acknowledgment of the loss of withdrawal rights
upon commencement. - Contracts concluded at public auctions.
- Service contracts fully performed if initiated with the consumer’s prior explicit consent.
Scope and Acceptance of Terms and Conditions: In addition to relevant legislation, our
General Terms and Conditions govern the contract’s content. This includes the rights and
obligations of both parties, contract terms, payment, and delivery conditions, deadlines, liability
rules, and the exercise of withdrawal rights. By placing an order, you accept our company’s
General Terms and Conditions as part of the binding contract.
Language and Form of Contract: The contract language is Hungarian and English. The
contract is formed by placing an order and becomes valid upon payment, subject to acceptance of
our General Terms and Conditions.
Complaint Handling and Dispute Resolution: Consumers may address complaints related to
our services at publishing@brightmindmedia.net. Complaints can be submitted in writing or, in
some cases, verbally. Complaints may concern the behavior, work, or omissions of company
representatives directly related to service distribution or sales.
Oral complaints will be immediately investigated and resolved, if possible. If the consumer
disagrees with the handling or an immediate investigation is impossible, a record of the
complaint and the company’s response will be prepared, with a copy sent to the consumer (or
provided on-site if in person). Complaints submitted by email will be addressed within 30 days.
Written complaints will receive a response within 30 days. If a complaint is rejected, we will
explain our reasons and provide a unique reference number for telephone or electronic
complaints.
Dispute Resolution Options: If a dispute remains unresolved through negotiations, consumers
may consider further legal remedies:
Online Dispute Resolution Platform: Consumers may resolve disputes related to online
purchases without court proceedings through the EU’s Online Dispute Resolution platform at
https://webgate.ec.europa.eu/odr/main/?event=main.home.show&lng=HU.
Copyright: Our website qualifies as a copyrighted work under Act LXXVI of 1999 on
Copyright. The unauthorized use of images, text, software, and graphic programs on our website
is prohibited, as is the use of applications that modify our website without permission. Taking
materials from our website or database is only allowed with written permission from the rights
holder BRIGHT MIND MEDIA KFT and with source attribution. Videos are watermarked to
protect copyrights.
Partial Invalidity and Code of Conduct: If any part of our General Terms and Conditions is
deemed legally invalid or unenforceable, relevant legal provisions shall apply to that part. The
rest of the contract remains valid. We do not adhere to any consumer code of conduct regarding
unfair commercial practices.
Technical Safeguards and Digital Content Functionality: The servers hosting our website
provide over 99.9% uptime annually. All data is regularly backed up to ensure recovery in case
of technical issues. Website data is stored in MySQL and MSSQL databases, encrypted
appropriately due to its sensitive nature.
Correction of Data Entry Errors and Responsibility for Data Accuracy: Before confirming
your order, you can modify your data as needed. You are responsible for the accuracy of the
provided data, as we use it for invoicing. We exclude liability for performance based on incorrect
data entry.
In the event of an incorrect email address or a full mailbox that prevents order confirmation from
being delivered, the formation of the contract may be obstructed.
Procedure for Incorrect Price: We exclude liability for prices that are incorrectly displayed due
to technical system errors. Examples of clearly incorrect prices include:
- 0 EUR,
- A discounted price is incorrectly displayed (e.g., the original price of 3,000 EUR with a
20% discount showing as 500 EUR instead of the correct 2,400 HUF).
If an incorrect price is displayed, we will inform you and offer the option to purchase the product
at the correct price, or you may cancel the purchase without consequence.
Finalizing Orders: If all order details are correct, you may finalize your order by clicking the
“Place Order” button. You will receive confirmation on our website and via email. If you notice
incorrect information in the confirmation email, please inform us within 24 hours.
Information on our website does not constitute a binding offer for a contract. By clicking “Place
Order,” you acknowledge that your offer is binding and that payment is required immediately. If
we do not confirm your offer within 48 hours or if card payment fails, you are released from any
obligation.
Payment Methods: Our products and services are available exclusively through card payment.
Delivery Methods: For virtual products such as subscriptions, no physical delivery occurs.
Participation tickets for webinars or workshops are sent by email. For physical books, delivery
within Hungary takes 2-4 days; international delivery times vary based on the delivery method
and are outside our control once the product is shipped.
Definitions:
- Parties: Seller and Consumer/Business collectively.
- Consumer: An adult (18+) natural person acting outside of economic or professional
activities. - Consumer Contract: A contract with one party considered a Consumer.
- Warranty: In consumer contracts, warranty obligations based on the Civil Code and
extending beyond statutory requirements. - Printed Book: A tangible product in printed format.
- E-book: The virtual format of the printed book.
- License: Exclusive rights to any online meeting recording belong to the author or
instructor. Copying, reproducing, or sharing recordings without permission is strictly
prohibited. Unauthorized reproduction may result in maximum compensation claims.
Intellectual Property Rights and Compensation for Unauthorized Use: Ownership and Control
All content produced during online meetings, including recordings and materials, is the exclusive
property of the author/instructor (“Owner”). The Owner retains full control over this content,
which cannot be shared or accessed by third parties without prior written consent.
Usage Restrictions Copying, reproducing, distributing, or sharing content without the Owner’s
explicit written permission is strictly prohibited. Unauthorized use constitutes a breach of this
contract and may result in legal action.
Compensation for Unauthorized Use If unauthorized use, copying, reproduction, or distribution
of content is discovered, the Owner reserves the right to claim the maximum compensation
permitted by law, including: - Statutory Compensation: The Owner is entitled to statutory damages based on intellectual
property and copyright laws, potentially including maximum damages in cases of
intentional infringement. - Actual Damages: The Owner may also seek compensation for actual losses incurred due
to unauthorized use, including lost revenue, damage to reputation, and associated legal or
investigative costs. - Legal and Administrative Costs: The Owner is entitled to recover reasonable legal fees,
administrative expenses, and other related costs associated with enforcing rights against
unauthorized use. - Punitive Damages: In cases of intentional or malicious infringement, the Owner may
pursue punitive damages to deter future unauthorized use.
Governing Law and Jurisdiction This agreement is governed by Hungarian law and will be
interpreted accordingly. Hungarian courts have jurisdiction over disputes arising from
unauthorized use, which may result in compensation based on actual damages or twice the actual
loss in cases of intentional infringement, including significant reputational harm and lost profit.
Contract Formation: A service agreement between the Provider and the Student is established
through website and email interactions.
Distance Contract: A contract to provide services concluded without the simultaneous physical
presence of the parties, using remote communication methods.
Remote Communication Tools: Tools that enable contract statements between parties without
being physically present, such as internet-accessible devices, forms, catalogs, or phones.
Training: Educational videos are offered on our website as part of a service contract, available
for a fixed period as specified on the training page.
Business: An individual acting within their economic or professional activities.
Website: Our webshop is where contracts are formed.
Workshop: A live training or professional conversation held at a scheduled time.
Webinar: An interactive online, real-time discussion or professional consultation.
